Can I Smoke Medical Marijuana in Public?
Unfortunately, the answer is no. Although medical marijuana is legal in the state of Missouri, smoking in public is still against the law. It is illegal to consume cannabis “anywhere that is open to the general public.”
This includes but is not limited to:
Sidewalks
Streets
Bridges
Parks
Schools
Buses
Remember that there are many ways to consume cannabis without blatantly lighting up. Edibles and tinctures are far less conspicuous; and you can also enjoy your medical marijuana before going out, then get a ride, walk, or take public transportation to wherever you’re heading.
You CAN consume marijuana in areas designated for private consumption.
The law does provide an option for those looking to consume marijuana outside the confines of home. It allows business or property owners to designate a “non-public space,” which is described as an “enclosed private space where one qualifying patient may consume medical marijuana.” Unfortunately, unless you’re a solitary smoker, it’s not much of a concession.
Pitch a tent in a state park.
Missouri has recently changed some of their policies regarding the use of medical marijuana in state parks. Residents with a medical marijuana card may use cannabis in private settings. That means you can smoke in your tent or RV with no problem. Just make sure to bring your card, and double check that you’re in a state park and NOT a federal one.
Missouri has a private cannabis club.
If you’d like to enjoy your cannabis with others, St. Louis’s Cola Lounge is your best bet. It’s legal to smoke here, because The Cola is a private club that requires you to register to have access. It is NOT a dispensary, and the rules are clear that you must “bring your own cannabis.” There is no selling, but members are encouraged to share and trade.
In addition to having a lounge where members can relax together and enjoy their own medical marijuana, the club offers social events and an “infusion kitchen” that occasionally holds edibles cooking classes.
Right now, The Cola Lounge seems to be Missouri’s only private cannabis club, leaving the market wide open for an option outside the St. Louis area. The Cola Lounge’s Facebook page has information on registration, and regularly posts about special events.
The best place to enjoy medical marijuana is still at home.
Without a lot of public options, the best place for you to enjoy cannabis in Missouri is still in your own home. It is perfectly legal for medical marijuana card holders to possess and consume cannabis products in their private residences. DO NOT bring marijuana on federal property.
This information is important, because federal law supersedes state legislation. Although medical marijuana is legal in Missouri, possession of cannabis is still a crime on federal land, whether or not you have a medical card. It appears that some authorities are letting possession slide as long as you don’t light up, but do so at your own risk. Technically, having marijuana on your person on federal land is against the law, even if you aren’t smoking, vaping or otherwise ingesting it. If you are going to be on federal property, leave your cannabis at home.
